NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, April 13, 2016 at 7:00 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Robert McIntyre, Philip Broadhurst, A. Spargo (arrived at 7:10 not seated), Carl VonDassel, Jr., alternate (seated) and Adam Boyd, alternate

Absent:  Kenneth Mikulski, alternate

Present:  Kim Barrows, Clerk

The meeting was then called to order at 7:00 p.m.  The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

15/16-30  Chris Crosson, seeks a variance of  Par 10.7.1 & 10.7.2 (non-conformity enlargement/change) and Par 24.5.1 (street setback/25’ required/14.8’ proposed) of the Zoning Regulations to permit construction of an attached 168 s.f. shed at 2 West View Circle, Map 21/Lot 8, Residence A District, Coastal Management Zone.

Discussion with respect to the public hearing that closed this evening.  There is an existing shed on the property that is dilapidated and an eyesore.  Applicant would like to attach a new shed addition to the existing garage.  By doing this it increases the setback an additional four inches and will be more aesthetically pleasing.  It was stated that this proposal is not an “accessory” structure but an addition to the house with access through the garage.  It was discussed that the addition is it not become habitable space. There will be no water or heat in the space, only electricity for lighting.  

A Motion was made by R. McCall, seconded by R. McIntyre to GRANT w/condition Application 15/16--30 Chris Crosson.  The granting of the variance would be correcting a problem with a shed which is useless and dilapidated.  The shed addition will not encroach any further into the setback than already exists. The addition enhances the aesthetic appearance of the home and the garage. The condition is that there will be no connections for utilities except for electrical and the addition will not become habitable space.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, C. VonDassel  Opposed: None     Abstaining: None   The Motion passed. 5-0-0

15/16-31  Spencer 95, LLC seeks a variance of Par 34.5.1 (maximum number of stories/2.5 allowed/3.0 proposed) of the Zoning Regulations to permit the construction of a self storage facility (warehouse) on a 65,464 s.f. property at 47 Spencer Plain Road, Map 25/Lot 25, Gateway Business B-4 District.

Discussion with respect to the public hearing that closed this evening. The proposal is for climate controlled storage units, approximately 350 units.  The topography of the lot slopes [slopes from 40’ to 20’ at the end of the building] so there is a portion of the structure that does not meet the zoning regulation definition of a “basement”, so therefore it is considered a three story structure instead of the actual two and a half story structure with a typical “walk-out” basement.  The last unit will house the platform for the loading dock.  The lot is a 5 acre parcel and this type of development is a good fit for the area since it will not increase the traffic flow.   Also this development is not adjacent to a residential neighborhood since there are railroad tracks on one side and Interstate 95 on the other.

A Motion was made by R. McIntyre, seconded by D. Alexander to GRANT Application 15/16-31 Spencer 95, LLC. The hardship is the topography and the slope of the lot plus based on the necessity of the loading dock being on the lowest level and where the widest area where the trucks can transit that location for safety, that makes it the best place for the loading dock.  The variance granted is for the 3rd story where the regulations allow only two and a half.  Discussion: P. Broadhurst stated that the third story issue pertains only to the extreme most remote part of the building away from Spencer Plains Road.  R. McCall stated that it does not conflict in any way with the surrounding area as a nonconformity since there are no nearby residences since it is surrounded by the railroad and the Interstate. No further discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, C. VonDassel  Opposed: None     Abstaining: None   The Motion passed. 5-0-0

Minutes: A Motion was made by R. McCall, seconded by D. Alexander to APPROVE the March 9, 2016 Regular Meeting Minutes as submitted.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, P. Broadhurst, C. VonDassel  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0

Adjournment:  A Motion was made by R. McCall, seconded by D. Alexander to adjourn the April 13, 2016 Regular Meeting of the Zoning Board of Appeals.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, P. Broadhurst, C. VonDassel  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at
